Victimless Crimes



The 112th Congress should:

  • abolish and oppose all "victimless crime" laws

Not everything that is "sinful" should be a "crime." "Gluttony" is a sin, but should not be punishable by jail or fines. The basic question is whether a sin involves an aggression against the life, liberty, or property of another.

Some "victimless" crimes do have victims -- a kind of "blowback." Addicts often leave their families uncared for, and fail to meet employer expectations on the job. But not all addicts leave victims. Some are responsible for their families, hold down prestigious jobs, and they should not be charged with a crime until they commit one. Responsible, non-victimizing use of drugs should not be a crime in itself.
