Choosing a Supreme Court Justice

The White House Press Office: In his weekly address, President Barack Obama called for a rigorous, principled and swift confirmation for his Supreme Court nominee, Court of Appeals Judge Sonia Sotomayor.  Judge Sotomayor’s extraordinary professional career, as a New York City prosecutor, a litigator, and as a judge for 17 years, is matched only by her remarkable life story, from growing up in a housing project to graduating from Princeton University and Yale Law School.  With the depth of her experience, she will be a prudent Justice who respects and adheres to the Constitution and the law.  (continued below)


How the President Differs from the American vision of "Liberty Under God":

Sotomayor has become known as The 'Empathy' Nominee. She will be a better judge because she can "empathize" with certain people better than white males:

In a speech published in the Berkeley La Raza Law Journal in 2002, Judge Sotomayor offered her own interpretation of this jurisprudence. "Justice [Sandra Day] O'Connor has often been cited as saying that a wise old man and wise old woman will reach the same conclusion in deciding cases," she declared. "I am . . . not so sure that I agree with the statement. First, . . . there can never be a universal definition of wise. Second, I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life."

We are supposed to have "a government of laws, not of men," but now we have a government of classes, not laws. Decisions are made on the basis of personal preference, not predictable, objective law.

Ann Coulter writes:  

     But all liberals only have empathy for the exact same victims -- always the ones that are represented by powerful liberal interest groups. As Joe Sobran says, it takes a lot of clout to be a victim.
     Thus, the media and Democrats seem to find successful Hispanic attorney Sotomayor much more "empathetic" than successful Hispanic attorney Miguel Estrada.
     After aggressively blocking Estrada's nomination to a federal appeals court during Bush's first term solely on the grounds that he is Hispanic and was likely headed for the Supreme Court -- according to Senate Democrat staff memos -- now Democrats have the audacity to rave that Sotomayor will be the first Hispanic Supreme Court justice!
     If Sotomayor is not more empathetic than Estrada, liberals at least consider her more Hispanic -- an interesting conclusion inasmuch as Sotomayor was born in New York and Estrada was born in Honduras.
     Forty-four of 48 Senate Democrats voted to filibuster Estrada's nomination to the D.C. Circuit Court of Appeals, with congressman and professional Hispanic Raul Grijalva assuring them that just because "he happens to be named 'Estrada' does not give him a free ride."
     The truth is liberals couldn't care less about Sotomayor being Hispanic. Indeed, liberals often have trouble telling Hispanic people apart, as James Carville illustrated on "Good Morning America" Wednesday morning when he kept confusing Miguel Estrada with Alberto Gonzales.
     "Empathy," in Liberalspeak, is nothing but raw political power.

This racism issue is just a surface issue. The deeper issue is this:

Why does a Supreme Court Justice wear a black robe?

It's a reminder that "Western Civilization" is Christian Civilization, and America was created as a Christian nation. It wasn't atheists who decided that Pastors, Judges and University Professors would wear robes. But it was atheists who set out to "capture the robes" -- that is, to transform education, the law, and even churches, into instruments of social change -- change from Christian civilization to the rule of Secular Humanism. Obama continues this tradition.

America's Founding Fathers said a Christian nation like ours should have Christian judges, because judges, like Pastors, are "ministers of God."


How would the Law operate
if we followed the Constitution
instead of racial preferences and liberal ideology?

  • The Constitution created a federal government with very limited powers, bound down by the "chains of the constitution." The Bush-Obama Regime believes it has vast, unlimited powers to bring salvation.

  • America was founded on the philosophy of "Liberty Under God."
    • "Liberty" means freedom from government suppression of ideas and confiscation of wealth
    • "Under God" means we have a personal responsibility to love God and neighbor.
  • The original American Dream: Everyone dwelling safely under his own Vine & Fig Tree
    • Human beings are endowed with the right to property by God, not the government.
  • The Constitution created a federal government of very limited power and few functions.
  • Most politicians who take an oath to "support the Constitution" are ignorant of its most basic assumptions.
    • The federal government only has the powers granted to it -- "enumerated" -- in the Constitution.
    • The "General Welfare" clause is no exception to this principle.
    • "States Rights" -- most government should be carried out on a local level.
  • America was founded as a "City upon a Hill," a Christian nation from which the Gospel would be promoted around the world.
  • This new government was not intended to be the policeman of the world.
  • The American people, acting as businessmen, humanitarians, and missionaries, would engage in commercial and charitable activities around the world.
    • The great rule of conduct for us, in regard to foreign nations is in extending our commercial relations to have with them as little political connection as possible."

    • I deem [one of] the essential principles of our government, and consequently [one] which ought to shape its administration,…peace, commerce, and honest friendship with all nations, entangling alliances with none.

  • Bush's unconstitutional military invasion of Iraq has destroyed Christianity in that country.
    • Under Saddam Hussein's secular government, Christians in Iraq had greater freedom than in most other Arab nations, and one of the largest Christian populations in the Muslim world was in Iraq.
    • Iraq is now an Islamic theocracy under Sharia law. The Christian population has been destroyed. Christian Churches are burned and terrorized with impunity.
  • Obama is following in Bush's footsteps.
  • America's Founders spoke of America as "an Experiment in Liberty" (1787-1887)
    • The "experiment" was a success: a Free Market made America the most prosperous and admired nation in history
  • In the 20th century, the experiment in liberty was replaced with another experiment: an experiment in central planning
  • The original American dream of personal, private ownership, has been replaced with private indebtedness and public control.
  • "No Taxation Without Representation" - a rallying cry of the American Revolution.
  • Taxation is a relatively unimportant federal revenue generator. The fed now creates money out of thin air
  • This money-creation system is immoral and unconstitutional. It steals from the poor and elderly.
  • America's Founding Fathers would conclude that The First Amendment had been repealed
    • There is no freedom of religion: the U.S. is officially atheistic.
    • There is no freedom of the press: the media is the lapdog of "the Establishment."
  • The Invisible Hand of the Free Market works better than the Visible Fist of Government

Liberty Under God"

 This week, I nominated Judge Sonia Sotomayor of the U.S. Court of Appeals to replace Justice David Souter, who is retiring after nearly two decades on the Supreme Court. After reviewing many terrific candidates, I am certain that she is the right choice.  In fact, there has not been a nominee in several generations who has brought the depth of judicial experience to this job that she offers. Experience doing what?  
Judge Sotomayor’s career began when she served as an Assistant District Attorney in New York, prosecuting violent crimes in America’s largest city. After leaving the DA’s office, she became a litigator, representing clients in complex international legal disputes. She was appointed to the U.S. District Court, serving six years as a trial judge where she presided over hundreds of cases. And most recently, she has spent eleven years on the U.S. Court of Appeals, our nation’s second highest court, grappling with some of the most difficult constitutional and legal issues we face as a nation. She has more experience on the federal bench than any incoming Supreme Court Justice in the past 100 years.  Quite simply, Judge Sotomayor has a deep familiarity with our judicial system from almost every angle. Some very bad judges and politicians accumulated a lot of experience before they were put out of office. 
And her achievements are all the more impressive when you consider what she had to overcome in order to achieve them.  Judge Sotomayor grew up in a housing project in the South Bronx; her parents came to New York from Puerto Rico during the Second World War. Her father was a factory worker with a third grade education; when she was just nine years old, he passed away. Her mother worked six days a week as a nurse to provide for her and her brother, buying the only set of encyclopedias in the neighborhood and sending her children to Catholic school. That’s what made it possible for Judge Sotomayor to attend two of America’s leading universities, graduating at the top of her class at Princeton University, and studying at Yale Law School where she won a prestigious post as an editor of the school’s Law Journal. This is what allegedly makes her more "empathetic."
These many years later, it was hard not to be moved by Judge Sotomayor’s mother, sitting in the front row at the White House, her eyes welling with tears, as her daughter – who had come so far, for whom she sacrificed so much – was nominated to the highest court in the land. The law is not supposed to be quite this personal. Should Supreme Court Justices be chosen because her mother cries?
And this is what makes Judge Sotomayor so extraordinary. Even as she has reached the heights of her profession, she has never forgotten where she began. She has faced down barriers, overcome difficult odds, and lived the American dream. As a Justice of the Supreme Court, she will bring not only the experience acquired over the course of a brilliant legal career, but the wisdom accumulated over the course of an extraordinary journey – a journey defined by hard work, fierce intelligence, and the enduring faith that, in America, all things are possible.  
It is her experience in life and her achievements in the legal profession that have earned Judge Sotomayor respect across party lines and ideological divides. She was originally named to the U.S. District Court by the first President Bush, a Republican.  She was appointed to the federal Court of Appeals by President Clinton, a Democrat.  She twice has been overwhelmingly confirmed by the U.S. Senate.  And I am gratified by the support for this nomination voiced by members of the legal community who represent views from across the political spectrum.  
There are, of course, some in Washington who are attempting to draw old battle lines and playing the usual political games, pulling a few comments out of context to paint a distorted picture of Judge Sotomayor’s record. But I am confident that these efforts will fail; because Judge Sotomayor’s seventeen-year record on the bench – hundreds of judicial decisions that every American can read for him or herself – speak far louder than any attack; her record makes clear that she is fair, unbiased, and dedicated to the rule of law. As a fellow judge on her court, appointed by Ronald Reagan, said recently, "I don’t think I’d go as far as to classify her in one camp or another. I think she just deserves the classification of outstanding judge." She is not dedicated to "the rule of law" any more than other politicians who say they are.
Congress returns this week and I hope the confirmation process will begin without delay. No nominee should be seated without rigorous evaluation and hearing; I expect nothing less. But what I hope is that we can avoid the political posturing and ideological brinksmanship that has bogged down this process, and Congress, in the past. Judge Sotomayor ought to be on the bench when the Supreme Court decides what cases to hear this year and I’m calling on Democrats and Republicans to be thorough, and timely in dealing with this nomination.  Is Obama talking about the way Estrada was treated by the Democrats?
As President, there are few responsibilities more serious or consequential than the naming of a Supreme Court Justice. The members of our highest court are granted life tenure.  They are charged with applying principles put to paper more than two centuries ago to some of the most difficult questions of our time. And the impact of their decisions extends beyond an administration, but for generations to come.  
This is a decision that I have not taken lightly and it is one that I am proud to have made. I know that Justice Sotomayor will serve this nation with distinction. And when she ascends those marble steps to assume her seat on the Supreme Court, bringing a lifetime of experience on and off the bench, America will have taken another important step toward realizing the ideal that is chiseled above its entrance: Equal justice under the law.

As you read the Gospel accounts, ask yourself how you would react if you knew these accounts were really true. Not just true in some "religious" sense, but reported in the New York Times, proven in a court of law, or acknowledged by your personal hero.  (How do you know something is true? Do you even have any "heroes?") How should you change your life if your Creator became a human being? How should Washington D.C. react if this human being claimed to be the true Ruler?

Bush claims the same global power of confiscation and migration as Caesar did. Thousands of Christians have been forced to move out of Iraq to make way for Bush's Islamic Theocracy.

Man's chief end is to glorify God and live in peace. The Bush Administration's chief end is to erect a "wall of separation" between God and government so that the State gives no glory to God, and to wage war, thereby "stimulating the economy."

"Wise men from the East" knew of Micah's prophecy that the King of the Jews would be born in Bethlehem.
Are there any wise men around the world who place their confidence in George Bush, Henry Paulson, Paul Krugman, or Barack Obama?

The kings from the east present the Messiah with "gold, frankincense, and myrrh."
Rather than bestowing wealth on the King, Obama-Bush confiscates the wealth of others.

When Herod got word of the birth of a rival king, he behaved in a perfectly logical way (for someone who wants to protect his power):  he massacred all male babies the age of Jesus. Herod recognized that Jesus was a threat to Herod's power.
Every day in America 4,000 unborn babies are murdered. These babies must threaten something.

Millions of Americans who call themselves Christians, on the other hand, are no threat to tyranny. None of them are being killed. Bush has killed a thousand times more human beings than Herod did, and confiscated a billion times more wealth than Herod did.

In the Republican Radio Address, Indiana Governor Mitch Daniels criticizes Nancy Pelosi's energy plan (OVTH transcript)  
This is Mitch Daniels governor of Indiana.  
The role of "the loyal opposition" is important in our democracy. It imposes a duty to wish for the nation's success, to express not just disagreements but agreements where they exist, and to leave partisanship at the water's edge. I do wish President Obama well. I support his education reform ideas, his anti-fraud initiative, and social programs, and the great example he and his family are setting for families across America. And I endorse wholeheartedly his stated commitment to government that works.  Government does not and cannot work. Socialism cannot succeed.
One policy being pushed by the president and House Speaker Nancy Pelosi is, I regret to say, a poster child for government that cannot work. The scheme to radically change the sources and the cost of American energy through a system known as "cap and trade" may be well-intentioned, but it will cost us dearly in jobs and income and it stands no chance of achieving its objective of a cooler earth.  
The national energy tax imposed by speaker Pelosi's climate change bill, would double electric bills here in Indiana, working a severe hardship on low income families, but that's only where the damage starts. In a state where we like to make things, like steel and autos and RVs, it would cost us countless jobs -- many of them heading offshore to China and India. Our farmers and livestock producers would see their costs skyrocket. And our coal miners would be looking for new work, while we leave affordable, homegrown energy idle in the ground.  
And all for what? Even if one believes the administration's own computer models which they claim can predict temperatures fifty years away, the CO2 reductions from their bill will not budge the world thermometer by a tenth of a degree.  
It's become clear that the Pelosi bill has little to do with a  cooler planet, and everything to do with raising money for the out-of-control federal spending now underway in Washington. Please excuse us Midwesterners for feeling a bit like the targets of an imperialistic policy devised in places like California and New York and Massachusetts for their benefit -- at our expense.  
We have here a classic example of unwise government. The cost for all Americans will be certain, huge, and immediate. Any benefits are extremely uncertain, miniscule, and decades distant. Surely there's a better way.  
Here in Indiana we are active in pursuing a better energy future and proving that we can protect the environment, lower energy costs, and create jobs at the same time -- all without raising taxes. We've rocketed to national leadership in biofuels. We're the nation's leader in the new technology that can use coal more cleanly. We're serious about major advances in conservation. The best way to reduce both pollution and CO2 is to use less energy in the first place. And last year we were the fastest growing state in wind power.  
There's tremendous risk in being pushed into an unfair and ultimately counterproductive national energy tax that will cost us dollars today, and jobs tomorrow. Let's take a breath, slow down, and work together on conservation, the infrastructure to bring on more wind and alternative energy, and the new technology that will let us use our abundant homegrown coal in ways we can all support. And that, Mister President, would be "government that works."

What Would America's Founding Fathers Do?

The men who threw tea into the Boston Harbor over a tax of 3 pence per pound would not be happy with a tax ten times greater on every gallon of gas. Those who took up muskets over a total tax burden of less than 3% would not be happy with the fact that the federal government now takes more than half of everything you earn.

Today it is illegal for public school teachers to teach their students that the Declaration of Independence is really true (and not just an outdated historical document). The federal government is clearly at war with everything the Founding Fathers stood for.

America's greatest Americans would abolish today's federal government.

Muskets are Not an Option

There are two reasons why we should not take up arms to pull off the violent overthrow of the federal government, even if America's Founders would surely do so. First, the feds have nukes. Second, violent revolution is unChristian and unBiblical. We must beat our swords into plowshares and use persuasion to abolish tyranny. This is time for a revolution of ideas.

Revolution Won't Come in a Day

John Adams once wrote that the American Revolution began in 1761, when Massachusetts attorney James Otis began legal challenges to the Writs of Assistance. He lost the case, but "American independence," Adams wrote, "was then and there born." Now do the math. That means it took 15 years to convince the rest of America to declare Independence (1776). Then another seven years of war was required before a Peace Treaty was signed (1783), and then six years before the Constitution was finally ratified (1789). That's almost 30 years. (And Jefferson said we shouldn't go 20 years without another rebellion!) How can we hope to convince Americans to fight for principles they were never taught in government schools? We need to be in this battle for the long term. "Eternal Vigilance is the Price of Liberty."

Stop the War for Terror
U.S. policy has inflamed the Middle East. It has made terrorism more likely rather than less. We seem to be fighting a war for terror, rather than on terror. This policy must stop. The place to start stopping is with Iran. We must not attack Iran. War with Iran would devastate our economy, disrupt world oil supplies, and recruit more terrorists.
